TERMS AND CONDITIONS OF USE
1. Acceptance of Terms
Access to and use of any of THE TRUST FOR THE AMERICAS digital platforms — hereinafter “the Platforms” — implies full and unreserved acceptance of these Terms and Conditions of Use (“Terms”). If the user does not agree with any of the provisions contained herein, they must refrain from using the Platforms. THE TRUST FOR THE AMERICAS reserves the right to modify these Terms at any time, and it is the user’s responsibility to review them periodically.
2. Description of Platforms
2.1 Institutional Website — www.trust-oea.org
General information platform about the mission, programs, publications, and institutional activities of THE TRUST FOR THE AMERICAS. Access is public and does not require registration.
2.2 Registration and Enrollment System — nuevo.sit.trustfortheamericas.org
Platform for the registration and monitoring of participants, organizations, and beneficiaries in THE TRUST FOR THE AMERICAS programs, courses, and activities. Access to specific features requires the creation of a user account. For certain projects, registration management is handled through the administrative panel available at https://registro.trustfortheamericas.org/apcaa/admin/, which is part of the same system.
2.3 Online Learning Platforms
Platforms for the delivery of courses, training, and educational programs:
- aulavirtual.trustfortheamericas.org — general institutional training platform.
- capacitate.trust-oea.org — capacity-building courses platform for the region.
- brasil-capacitate.trust-oea.org — capacity-building courses platform for Brazil.
- cursosia.trust-oea.org — specialized platform for artificial intelligence courses.
Users may include individual participants, registered organizations, minors with authorization from their legal guardian, and external instructors or facilitators linked to institutional programs. The terms of use, certifications, and conduct standards described in these Terms apply to all platforms listed.
3. Registration and User Accounts
3.1 Accuracy of information.
The user warrants that the information provided at the time of registration is truthful, complete, and up to date. THE TRUST FOR THE AMERICAS may suspend access for any user who provides false or inaccurate information.
3.2 Confidentiality of credentials.
The user is responsible for maintaining the confidentiality of their username and password and for all activities carried out under their account.
3.3 Minors.
Registration of minors requires the express authorization of their parents, guardians, or legal representatives, in accordance with the Privacy and Data Protection Policy of THE TRUST FOR THE AMERICAS.
4. Permitted Use and User Conduct
The user agrees to use the Platforms solely for the lawful purposes established by THE TRUST FOR THE AMERICAS. The following are expressly prohibited:
- Reproducing, distributing, modifying, or commercially exploiting Platform content without prior written authorization.
- Publishing, transmitting, or sharing offensive, discriminatory, illegal content or content that violates the rights of third parties.
- Attempting unauthorized access to systems, data, or other users’ accounts.
- Using the Platforms for spam, phishing, malware distribution, or any fraudulent activity.
- Impersonating another person, organization, or entity.
- Interfering with the normal operation of the Platforms or their computer systems.
5. Intellectual Property
All content available on the Platforms — including texts, images, videos, course materials, logos, trademarks, and designs — is the property of THE TRUST FOR THE AMERICAS or its licensors and is protected by applicable intellectual property laws. Access to the Platforms does not grant the user any rights over such content beyond the expressly authorized personal and non-commercial use.
6. Certificates and Credentials from the Virtual Classroom
Courses and programs in the Virtual Classroom may award:
- Certificates issued by THE TRUST FOR THE AMERICAS, accrediting participation in and completion of the program.
- Certificates endorsed by partner universities, institutions, or government entities, as expressly indicated in the description of each program.
THE TRUST FOR THE AMERICAS does not guarantee automatic recognition of certificates by third-party institutions or employers. The official validity of each certificate is subject to the agreements in force with the endorsing institutions indicated in each program.
7. Suspension of Access
THE TRUST FOR THE AMERICAS reserves the right to temporarily suspend access for any user who fails to comply with these Terms, without prior notice when the severity of the situation so requires. The suspension may be lifted once the user remedies the breach or provides satisfactory explanations to the organization. In cases of repeated or serious violations, permanent account cancellation may follow.
8. Limitation of Liability
THE TRUST FOR THE AMERICAS shall not be liable for direct, indirect, incidental, or consequential damages arising from the use or inability to use the Platforms, including service interruptions, technical errors, or data loss. The organization also assumes no responsibility for the content of third-party websites linked from the Platforms.
9. Privacy and Data Protection
The processing of users’ personal data is governed by the Privacy and Data Protection Policy of THE TRUST FOR THE AMERICAS, available on each of the Platforms and grounded in the OAS Updated Principles (AG/RES. 2974 (LI-O/21)). Said Policy forms an integral part of these Terms.
10. Amendments and Updates
THE TRUST FOR THE AMERICAS reserves the right to update or modify these Terms at any time. Changes will be published on the Platforms and will take effect upon publication. Continued use of the Platforms after publication of changes constitutes acceptance of the modified Terms.
11. Applicable Law and Jurisdiction
These Terms are governed by the laws of the District of Columbia, United States of America, without prejudice to consumer protection and data privacy provisions applicable in the user’s country of residence. For any dispute, the parties shall submit to the amicable resolution mechanisms available through the organization before resorting to judicial proceedings.
