Acceptance of Terms<\/h5><p>Access to and use of any of THE TRUST FOR THE AMERICAS digital platforms \u2014 hereinafter \u201cthe \nPlatforms\u201d \u2014 implies full and unreserved acceptance of these Terms and Conditions of Use (\u201cTerms\u201d). If \nthe user does not agree with any of the provisions contained herein, they must refrain from using the \nPlatforms. THE TRUST FOR THE AMERICAS reserves the right to modify these Terms at any time, and it \nis the user\u2019s responsibility to review them periodically.<\/p><h5>2. Description of Platforms<\/h5><h5>2.1 Institutional Website \u2014 www.trust-oea.org<\/h5><p>General information platform about the mission, programs, publications, and institutional activities of THE \nTRUST FOR THE AMERICAS. Access is public and does not require registration.<\/p><h5>2.2 Registration and Enrollment System \u2014 nuevo.sit.trustfortheamericas.org<\/h5><p>Platform for the registration and monitoring of participants, organizations, and beneficiaries in THE TRUST \nFOR THE AMERICAS programs, courses, and activities. Access to specific features requires the creation \nof a user account. For certain projects, registration management is handled through the administrative panel \navailable at <a href=\"https:\/\/registro.trustfortheamericas.org\/apcaa\/admin\/\">https:\/\/registro.trustfortheamericas.org\/apcaa\/admin\/<\/a>, which is part of the same system.<\/p><h5>2.3 Online Learning Platforms<\/h5><p>Platforms for the delivery of courses, training, and educational programs:<\/p><ul><li>aulavirtual.trustfortheamericas.org \u2014 general institutional training platform.<\/li><li>capacitate.trust-oea.org \u2014 capacity-building courses platform for the region.<\/li><li>brasil-capacitate.trust-oea.org \u2014 capacity-building courses platform for Brazil.<\/li><li>cursosia.trust-oea.org \u2014 specialized platform for artificial intelligence courses.<\/li><\/ul><p>Users may include individual participants, registered organizations, minors with authorization from their \nlegal guardian, and external instructors or facilitators linked to institutional programs. The terms of use, \ncertifications, and conduct standards described in these Terms apply to all platforms listed.<\/p><h5>3. Registration and User Accounts<\/h5><h5>3.1 Accuracy of information.<\/h5><p>The user warrants that the information provided at the time of registration is \ntruthful, complete, and up to date. THE TRUST FOR THE AMERICAS may suspend access for any user \nwho provides false or inaccurate information.<\/p><h5>3.2 Confidentiality of credentials.<\/h5><p>The user is responsible for maintaining the confidentiality of their \nusername and password and for all activities carried out under their account.<\/p><h5>3.3 Minors.<\/h5><p>Registration of minors requires the express authorization of their parents, guardians, or legal \nrepresentatives, in accordance with the Privacy and Data Protection Policy of THE TRUST FOR THE \nAMERICAS.<\/p><h5>4. Permitted Use and User Conduct<\/h5><p>The user agrees to use the Platforms solely for the lawful purposes established by THE TRUST FOR THE \nAMERICAS. The following are expressly prohibited:<\/p><ul><li>Reproducing, distributing, modifying, or commercially exploiting Platform content without prior written authorization.<\/li><li>Publishing, transmitting, or sharing offensive, discriminatory, illegal content or content that \nviolates the rights of third parties.<\/li><li>Attempting unauthorized access to systems, data, or other users\u2019 accounts.<\/li><li>Using the Platforms for spam, phishing, malware distribution, or any fraudulent activity.<\/li><li>Impersonating another person, organization, or entity.<\/li><li>Interfering with the normal operation of the Platforms or their computer systems.<\/li><\/ul><h5>5. Intellectual Property<\/h5><p>All content available on the Platforms \u2014 including texts, images, videos, course materials, logos, \ntrademarks, and designs \u2014 is the property of THE TRUST FOR THE AMERICAS or its licensors and is \nprotected by applicable intellectual property laws. Access to the Platforms does not grant the user any rights over such content beyond the expressly authorized personal and non-commercial use.<\/p><h5>6. Certificates and Credentials from the Virtual Classroom<\/h5><p>Courses and programs in the Virtual Classroom may award:<\/p><ul><li>Certificates issued by THE TRUST FOR THE AMERICAS, accrediting participation in and \ncompletion of the program.<\/li><li>Certificates endorsed by partner universities, institutions, or government entities, as expressly \nindicated in the description of each program.<\/li><\/ul><p>THE TRUST FOR THE AMERICAS does not guarantee automatic recognition of certificates by third-party \ninstitutions or employers. The official validity of each certificate is subject to the agreements in force with \nthe endorsing institutions indicated in each program.<\/p><h5>7. Suspension of Access<\/h5><p>THE TRUST FOR THE AMERICAS reserves the right to temporarily suspend access for any user who fails to comply with these Terms, without prior notice when the severity of the situation so requires. The suspension may be lifted once the user remedies the breach or provides satisfactory explanations to the organization. In cases of repeated or serious violations, permanent account cancellation may follow.<\/p><h5>8. Limitation of Liability<\/h5><p>THE TRUST FOR THE AMERICAS shall not be liable for direct, indirect, incidental, or consequential \ndamages arising from the use or inability to use the Platforms, including service interruptions, technical errors, or data loss. The organization also assumes no responsibility for the content of third-party websites linked from the Platforms.<\/p><h5>9. Privacy and Data Protection<\/h5><p>The processing of users\u2019 personal data is governed by the <b>Privacy and Data Protection Policy<\/b> of THE TRUST FOR THE AMERICAS, available on each of the Platforms and grounded in the OAS Updated Principles (AG\/RES. 2974 (LI-O\/21)). Said Policy forms an integral part of these Terms.<\/p><h5>10. Amendments and Updates<\/h5><p>THE TRUST FOR THE AMERICAS reserves the right to update or modify these Terms at any time. \nChanges will be published on the Platforms and will take effect upon publication. Continued use of the Platforms after publication of changes constitutes acceptance of the modified Terms.<\/p><h5>11. Applicable Law and Jurisdiction<\/h5><p>These Terms are governed by the laws of the District of Columbia, United States of America, without prejudice to consumer protection and data privacy provisions applicable in the user\u2019s country of residence. For any dispute, the parties shall submit to the amicable resolution mechanisms available through the organization before resorting to judicial proceedings.<\/p><h5>12. Su uso es p\u00fablico y no requiere registro. 2.2 Sistema de Inscripci\u00f3n y Registro \u2014 nuevo.sit.trustfortheamericas.org Plataforma para el registro e monitoreo de participantes, organizaciones y beneficiarios a los programas, cursos y actividades de THE TRUST FOR THE AMERICAS. El acceso a funcionalidades espec\u00edficas requiere la creaci\u00f3n de una cuenta de usuario. Para determinados proyectos, la gesti\u00f3n de registros se realiza a trav\u00e9s del panel administrativo disponible en https:\/\/registro.trustfortheamericas.org\/apcaa\/admin\/, que forma parte del mismo sistema. 2.3 Plataformas de aprendizaje en l\u00ednea Plataformas destinadas a la impartici\u00f3n de cursos, capacitaciones y programas de formaci\u00f3n: aulavirtual.trustfortheamericas.org \u2014 plataforma general de formaci\u00f3n institucional. capacitate.trust-oea.org \u2014 plataforma de cursos de capacitaci\u00f3n para la regi\u00f3n. brasil-capacitate.trust-oea.org \u2014 plataforma de cursos de capacitaci\u00f3n para Brasil. cursosia.trust-oea.org \u2014 plataforma de cursos especializados en inteligencia artificial. Los usuarios pueden incluir participantes individuales, organizaciones inscritas, menores de edad con autorizaci\u00f3n de su representante legal, y docentes o facilitadores externos vinculados a programas institucionales. Las condiciones de uso, certificaciones y normas de conducta descritas en estos T\u00e9rminos aplican a todas las plataformas listadas. 3. Registro y Cuentas de Usuario 3.1 Veracidad de la informaci\u00f3n El usuario garantiza que la informaci\u00f3n proporcionada al momento del registro es veraz, completa y actualizada. THE TRUST FOR THE AMERICAS podr\u00e1 suspender el acceso de cualquier usuario que proporcione informaci\u00f3n falsa o inexacta. 3.2 Confidencialidad de credenciales El usuario es responsable de mantener la confidencialidad de su nombre de usuario y contrase\u00f1a, y de todas las actividades realizadas bajo su cuenta. 3.3 Menores de edad El registro de menores de edad requiere la autorizaci\u00f3n expresa de sus padres, tutores o representantes legales, conforme a lo establecido en la Pol\u00edtica de Privacidad y Protecci\u00f3n de Datos de THE TRUST FOR THE AMERICAS. 4. Uso Permitido y Conducta del Usuario El usuario se compromete a utilizar las Plataformas exclusivamente para los fines l\u00edcitos previstos por THE TRUST FOR THE AMERICAS. Queda expresamente prohibido: Reproducir, distribuir, modificar o explotar comercialmente los contenidos de las Plataformas sin autorizaci\u00f3n previa y escrita. Publicar, transmitir o compartir contenido ofensivo, discriminatorio, ilegal o que vulnere derechos de terceros. Intentar acceder de forma no autorizada a sistemas, datos o cuentas de otros usuarios. Utilizar las Plataformas para actividades de spam, phishing, distribuci\u00f3n de malware o cualquier actividad fraudulenta. Suplantar la identidad de otra persona, organizaci\u00f3n o entidad. Interferir con el funcionamiento normal de las Plataformas o sus sistemas inform\u00e1ticos. 5. Propiedad Intelectual Todos los contenidos disponibles en las Plataformas \u2014 incluyendo textos, im\u00e1genes, videos, materiales de cursos, logos, marcas y dise\u00f1os \u2014 son propiedad de THE TRUST FOR THE AMERICAS o de sus licenciantes, y est\u00e1n protegidos por las leyes de propiedad intelectual aplicables. El acceso a las Plataformas no otorga al usuario ning\u00fan derecho sobre dichos contenidos m\u00e1s all\u00e1 del uso personal y no comercial expresamente autorizado. 6. Certificados y Constancias del Aula Virtual Los cursos y programas del Aula Virtual pueden otorgar: Certificados propios de THE TRUST FOR THE AMERICAS, que acreditan la participaci\u00f3n y aprobaci\u00f3n del programa. Certificados avalados por universidades, instituciones socias o entidades gubernamentales, seg\u00fan se indique expresamente en la descripci\u00f3n de cada programa. THE TRUST FOR THE AMERICAS no garantiza el reconocimiento autom\u00e1tico de los certificados por parte de terceras instituciones o empleadores. La validez oficial de cada certificado queda sujeta a los acuerdos vigentes con las instituciones avaladoras indicadas en cada programa. 7. Suspensi\u00f3n del Acceso THE TRUST FOR THE AMERICAS se reserva el derecho de suspender temporalmente el acceso de cualquier usuario que incumpla los presentes T\u00e9rminos, sin necesidad de previo aviso cuando la gravedad de la situaci\u00f3n as\u00ed lo requiera. La suspensi\u00f3n podr\u00e1 levantarse una vez que el usuario subsane el incumplimiento o brinde las explicaciones pertinentes a satisfacci\u00f3n de la organizaci\u00f3n. En casos de reincidencia o infracciones graves, podr\u00e1 procederse a la cancelaci\u00f3n definitiva de la cuenta. 8. Limitaci\u00f3n de Responsabilidad THE TRUST FOR THE AMERICAS no ser\u00e1 responsable por da\u00f1os directos, indirectos, incidentales o consecuentes derivados del uso o la imposibilidad de uso de las Plataformas, incluyendo interrupciones del servicio, errores t\u00e9cnicos o p\u00e9rdida de datos. La organizaci\u00f3n tampoco asume responsabilidad por el contenido de sitios web de terceros enlazados desde las Plataformas. 9. Privacidad y Protecci\u00f3n de Datos El tratamiento de datos personales de los usuarios se rige por la Pol\u00edtica de Privacidad y Protecci\u00f3n de Datos de THE TRUST FOR THE AMERICAS, disponible en cada una de las Plataformas y fundamentada en los Principios Actualizados de la OEA (AG\/RES. 2974 (LI-O\/21)). Dicha Pol\u00edtica forma parte integrante de los presentes T\u00e9rminos. 10. Modificaciones y Actualizaciones THE TRUST FOR THE AMERICAS se reserva el derecho de actualizar o modificar los presentes T\u00e9rminos en cualquier momento. Los cambios ser\u00e1n publicados en las Plataformas y entrar\u00e1n en vigor desde su publicaci\u00f3n. El uso continuado de las Plataformas tras la publicaci\u00f3n de los cambios constituye la aceptaci\u00f3n de los T\u00e9rminos modificados. 11. Ley Aplicable y Jurisdicci\u00f3n Los presentes T\u00e9rminos se rigen por las leyes del Distrito de Columbia, Estados Unidos de Am\u00e9rica, sin perjuicio de las disposiciones de protecci\u00f3n al consumidor y privacidad de datos que resulten aplicables en el pa\u00eds de residencia del usuario. Para cualquier controversia, las partes se someter\u00e1n a los mecanismos de resoluci\u00f3n amistosa disponibles a trav\u00e9s de la organizaci\u00f3n antes de acudir a instancias judiciales. 12.
